Terms of Use for Kounts App

Welcome to Kounts! These Terms of Use ("Terms") govern your use of the Kounts mobile application (the "Application") and all related services. By downloading and using the Application, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Application.
1. APPLICATION LICENSE
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Application for personal, non-commercial purposes in accordance with these Terms. You may not:
- Copy, modify, or create derivative works from the Application
- Rent, lease, lend, sell, or otherwise transfer the Application
- Reverse engineer, decompile, or disassemble the Application
- Use the Application for any commercial purpose or for any public display
- Attempt to gain unauthorized access to the Application or related systems
2. KOUNTS PREMIUM SUBSCRIPTION
Kounts offers a free version and optional premium subscription tiers:
Free Forever
The basic version of Kounts is completely free to use forever with no expiration. You can:
- Create and manage unlimited event countdowns
- Use default categories and colors
- Access all core features indefinitely at no cost
Yearly Premium ($9.99/year)
The Yearly Premium subscription includes:
- Up to 10 custom categories
- Custom colors and symbols for your events
- All card styles and accent color options
- Calendar sync feature
- 7 days free trial, then $9.99 per year
Billing: Your subscription will renew automatically each year unless cancelled. You will be notified before each renewal.
Lifetime Premium ($19.99 once)
The Lifetime Premium subscription is a one-time purchase that grants you permanent access to all premium features:
- Up to 10 custom categories
- Custom colors and symbols for your events
- All card styles and accent color options
- Calendar sync feature
- One-time payment of $19.99
- Never expires — no recurring charges
Important: This is a one-time purchase. You will not be charged again unless you choose to make another purchase.
3. SUBSCRIPTION MANAGEMENT & CANCELLATION
You can manage your subscription directly through your device's app store settings:
- iPhone/iPad: Go to Settings → [Your Name] → Subscriptions → Kounts → Manage Subscription
- Cancel Anytime: You can cancel your Yearly subscription at any time. Your subscription will remain active until the end of the current billing period.
- Refund Policy: Refunds are governed by Apple's refund policy. For the Yearly subscription's 7-day free trial, you can cancel during the trial period for a full refund. Requests made after the trial period may be denied.
4. USER CONTENT
All event countdowns, categories, notes, and images you create in Kounts ("User Content") are entirely your own. You retain all rights to your User Content. By using the Application, you grant us a limited license to use your User Content only to provide and improve the Application's functionality.
Since all your data is stored locally on your device or in your personal iCloud account, you maintain complete control over your User Content. We do not access, analyze, or use your personal countdown data for any other purpose.
5. COMPLIANCE WITH LAWS
You agree to use the Application in compliance with all applicable laws, rules, and regulations. You are responsible for ensuring that your use of the Application does not violate any third-party rights, including intellectual property rights, privacy rights, or other legal rights.
6. DISCLAIMER OF WARRANTIES
THE APPLICATION IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE APPLICATION, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that:
- The Application will be uninterrupted or error-free
- Defects will be corrected
- The Application will be compatible with all devices or iOS versions
- Your data will never be lost
7. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF BUSINESS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability to you shall not exceed the amount you paid for the Application or subscription in the 12 months preceding the claim.
8. TERMINATION
We may terminate or suspend your access to the Application at any time, with or without cause, including if you violate these Terms. Upon termination:
- Your license to use the Application is revoked
- You must delete the Application from your device
- Any unused portion of your subscription will not be refunded (except as required by law)
9. CHANGES TO THE APPLICATION & TERMS
We reserve the right to modify the Application and these Terms at any time. If we make material changes to these Terms, we will notify you through the Application or via email. Your continued use of the Application following notification of changes constitutes your acceptance of the modified Terms.
10. THIRD-PARTY SERVICES
The Application may integrate with third-party services such as Google Analytics. Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the performance, functionality, or data practices of third-party services.
11. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer is located, without regard to its conflict of law provisions. Any legal action or proceeding related to these Terms shall be brought exclusively in the courts of that jurisdiction.
